Custody and Child-Rearing in the Legal Context in PanamaNormative and Jurisprudential Analysis

Abstract
Introduction: Shared custody is the legal process by which both parents share the responsibility of raising their children after separation. Objective: To examine the Panamanian normative and jurisprudential framework to determine the feasibility of incorporating shared custody into the national legal system. Method: A qualitative approach was used, based on documentary analysis of the Political Constitution, the Family Code, the Convention on the Rights of the Child, and rulings from the Judicial Branch. Results: Current legislation does not expressly regulate shared custody, although Supreme Court jurisprudence has recognized its applicability in specific situations. Conclusion: It is imperative to promote legislative reforms that incorporate joint custody as a legal institution in Panama, with the best interests of the child as the guiding principle.
